Payment and Delivery Process:

Upon successful payment, you will be emailed (to the email address recorded by PayPal Inc. during your successful payment process) access keys to download the product you have purchased. This link will remain active for 7 days from the date on which you purchased the product.

Conditions of use:

This product is intended to be used by the user being in a relaxed state, ideally lying down or sitting somewhere comfortable where the user will not be disturbed or distracted. Specifically you must not use the product while engaged in any activity or environment where such use could cause or contribute to injury or accident. Any liability for any injury or related matter is specifically excluded under the terms of use. For example: the product must not be used in a moving vehicle, or whilst operating machinery, or in an environment or manner where the use of the product may contribute to the user causing injury to self or others. Further, you must not use the product while under the influence of drugs, while receiving medical treatment or if you have a history of physical or mental illness. Your purchase and use of the product establishes your acceptance of these conditions of use. You agree that your failure to comply completely with the conditions of use of the product may be considered by Wyld Hypnotica to be a material breach of this agreement and that consequent upon such breach Wyld Hypnotica has no relationship with you and terminates any previous relationship. No fees will be refunded to you should your agreement be cancelled because of a breach.

It is also agreed and understood by you upon purchase, that neither developer, supplier or distributor are engaged in rendering a medical or psychological service or other professional service. This product is not intended to be a substitute for therapy or professional advice or any form of treatment for any disorder or illness.

Unauthorised copying:

Unauthorised copying is strictly prohibited except for the personal use of the purchaser. No relationship whatsoever exists between the user of the product and the supplier, distributor and supplier except where the user is the direct purchaser. Any user of this product, who was not the direct purchaser of the product from the authorised distributor, is excluded absolutely from any recourse of any kind against the suppliers, distributors or developers of this product.

Refund Policy:

Failure of download from the distributor's website to your computer at time of purchase is the only grounds for refund. You are responsible for ensuring your copy of the product is stored in a safe environment.

Duration of support:

The vendor's provision of product support for these products and services is based on their normal commercial life of 3 years after the date of purchase and ceases on that date. Wyld Hypnotica has no relationship with you beyond that date.

Disclaimer:

The product and the claims for it's potential reflect the developers and suppliers intention for your actualisation of your own innate potential. This product is offered for sale on the explicit understanding and agreement by you, upon purchase, that the product's effectiveness and your response to it cannot be guaranteed as they depend on individual potential. Individual results and experiences may vary. Results depend on you and are not in any way guaranteed by the supplier. You agree that Wyld Hypnotica contains only positive suggestions which you are free to accept or reject and is not responsible for any mental disorder or behavioural problems you may have or may develop.

Warranties:

You agree that any statements which may be posted on Wyld Hypnotica web sites or other sites promoting Wyld Hypnotica products, are of a general nature will not bind Wyld Hypnotica. You agree that Wyld Hypnotica shall not be bound by any representations made by third parties from whom you may have purchased Wyld Hypnotica products. Wyld Hypnotica expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose and non-infringement. Wyld Hypnotica makes no warranty that its product(s) will meet your requirements, or that the product(s) will be error free, or that defects will be corrected. Wyld Hypnotica does not warrant, nor make any representations regarding the use, or results of, any of the services it provides, in terms of their efficacy or otherwise.

Public statements:

You agree to preserve the good name of Wyld Hypnotica and refrain from making any reference to Wyld Hypnotica in public media except with the express permission of Wyld Hypnotica.

Product Promotion

You agree that we may email you from time to time information relating to other Wyld Hypnotica products. We appreciate your feedback and may use email communications from you in promotional material, in a way that does not identify you.

Limitation of liability

You agree that Wyld Hypnotica's entire liability to you under this agreement, and your only remedy, in connection with any product provided by Wyld Hypnotica to you shall be limited to the fees you paid to Wyld Hypnotica for the particular product in contention. Wyld Hypnotica and its agents and contractors shall not be liable for any direct, indirect incidental, special, or consequential damages resulting from the use of or inability to use any of Wyld Hypnotica's products or for the cost of obtaining other services.

Indemnity

You agree to release, defend, indemnify and hold harmless Wyld Hypnotica and its parent company, contractors, agents, employees, offices, directors, shareholders and affiliates from and against any losses, damages or costs, including reasonable attorney's fees, resulting from any claim, action, proceeding suit or demand arising out of or related to your (including your associates or anyone using your copy of the Wyld Hypnotica product whether or not with your permission) use of the products provided by Wyld Hypnotica. This provision takes precedence over the dispute resolution process outlined below.

Dispute Resolution

This agreement is deemed to be entered into in the State of Queensland, Australia. In jurisdictions that do not permit the limitation or elimination of liability for certain types of damage, and in the event of any dispute or disagreement with Wyld Hypnotica or its staff or assignees, you and your agent agree to enter into formal mediation with a professional mediator appointed by the professional association for lawyers or mediators in Australia. Either party may initiate the dispute resolution process and failure to enter into mediation is a further breach of this agreement. Such mediation will be conducted in the City of Brisbane in Queensland, Australia and all parties to the dispute are responsible for meeting their own costs of attendance at mediation. The allocation of mediation costs shall be determined by the mediator. No legal action may be entered into by either party until it is the opinion of the mediator that mediation is exhausted. In the event that mediation is exhausted and that any matter proceeds to legal action you agree that any action relating to or arising out of this agreement shall be brought in the courts of the State of Queensland, Australia, that the laws and judicial decisions of the State of Queensland, and Australia, shall be used to determine the validity, construction, interpretation and legal effect of this agreement. You also agree that Wyld Hypnotica's and Wyld Hynotica's Directors' and shareholders' liability shall be limited to the smallest amount permitted by law.

Severability, entirety:

You agree that the terms of this Agreement are severable. If any part of this Agreement is determined to be unenforceable or invalid, that part of the agreement will be interpreted in accordance in line with the original intention of both parties to the Agreement. The remaining terms and conditions of the Agreement will remain in full force and effect. You agree that this agreement constitutes the complete and only agreement between you and Wyld Hypnotica regarding the products contemplated herein.
